Acceptance of Terms

By accessing or using the Cend website, mobile application, or any of our associated services (collectively, the "Platform"), you agree to be bound by these Terms of Use and our Privacy Policy.

If you do not agree to these terms, you must not access or use the Platform. These terms constitute a legally binding agreement between you and Cend Global.

The Cend Platform

Cend provides a technology platform that connects users ("Riders" or "Senders") with independent third-party providers ("Drivers" or "Couriers") who provide transportation and/or logistics services.

Cend does not provide transportation or logistics services. We are a technology company. The decision to offer or accept services is an independent decision between the user and the third-party provider.

User Accounts & Security

To use most features of the Platform, you must register for and maintain an active personal user account. You must be at least 18 years of age to obtain an account.

• Accuracy — You agree to provide and maintain accurate, complete, and up-to-date information in your account.
• Security — You are responsible for all activity that occurs under your account and agree to maintain the security of your username and password at all times.
• Restrictions — You may not authorize third parties to use your account, and you may not assign or otherwise transfer your account to any other person or entity.

Using the Service

Your use of the Platform is subject to the following conditions:

• Compliance — You agree to comply with all applicable laws when using the Platform.
• Safety — You will not cause nuisance, annoyance, inconvenience, or property damage to the third-party provider or any other party.
• Prohibited Items — For delivery services, you may not send any items that are illegal, hazardous, or dangerous under applicable law.

Payments, Fees & Billing

You understand that use of the services may result in charges to you for the services you receive from a third-party provider.

• Pricing — Fares and fees are calculated based on distance, time, and service type. Estimates provided are not guaranteed.
• Mobile Money — We support payments via major mobile money providers in Ghana. By providing payment details, you authorize us to facilitate the transaction.
• Cancellations — You may be charged a cancellation fee if you cancel a request after it has been accepted by a provider.
• Refunds — Charges paid by you are final and non-refundable, unless otherwise determined by Cend.

Prohibited Conduct

You may not:

• Remove any copyright, trademark, or other proprietary notices from any portion of the Platform.
• Reproduce, modify, prepare derivative works based upon, distribute, license, or lease the Platform without Cend's express consent.
• Link to, mirror, or frame any portion of the Platform.
• Cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Platform.

Intellectual Property

The Platform and all rights therein are and shall remain Cend's property or the property of Cend's licensors. Neither these Terms nor your use of the Platform convey or grant to you any rights:

• In or related to the Platform except for the limited license granted above.
• To use or reference in any manner Cend's company names, logos, product and service names, trademarks, or services marks.

Account Termination

Cend may immediately terminate these Terms or any services with respect to you, or generally cease offering or deny access to the Platform or any portion thereof, at any time for any reason.

You may terminate these Terms at any time by requesting the deletion of your account.

Disclaimers & Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." CEND DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS.

CEND SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE PLATFORM.

Cend does not guarantee the quality, suitability, safety, or ability of third-party providers. You agree that the entire risk arising out of your use of the services remains solely with you.

Governing Law

Except as otherwise set forth in these Terms, these Terms shall be exclusively governed by and construed in accordance with the laws of the Republic of Ghana.

Any dispute, conflict, claim, or controversy arising out of or broadly in connection with or relating to the Platform or these Terms shall be first submitted to settlement proceedings under the Ghana Arbitration Act.
